Here we go again! VOTE NO HB 203!
As you know from serving on your community’s board of directors, or serving many communities as a manager, even getting 2 or 3 people to agree can be challenging.
Last year, CAN brought together community volunteer leaders and the major statewide community association coalitions representing more than 5 million people to stand against “A GROTESQUE PRICE FIXING BILL” as stated by SPB, SaintPetersBlog. This terrible Bill is funded by real estate title companies who invested more than $2 Million dollars in campaign contributions to ensure closing costs are shifted from them to you!
This year’s version of the proposed new law, HB 203, is up to bat again TOMORROW, Tuesday, November 3, 2015 at 9:00 a.m. before the House Civil Justice Subcommittee. This proposed law is nearly identical to last year’s Bill. It includes all of the same harmful provisions that will increase costs on your community association. This bill would increase costs on homeowners in the following ways:
(1) Making communities wait and see if the sale closes before getting paid for work the community must prepay to obtain;
(2) Communities are obliged to prepay costs. This bill would cap amounts title companies must reimburse associations. If the actual costs are higher, you pay the difference!; and
(3) If a home does not sell, associations will not be paid for their prepaid costs and services. End of story. The cost for those services must then be paid through higher fees and assessments on existing homeowners.
